(A) Civil penalty.
(1) Each separate violation of §§ 97.035 through 97.039 and § 97.111(E) constitutes a civil offense for which the civil penalty authorized by KRS 82.600 through 82.640 shall be $20, which shall be doubled in the event that the citation is not paid or otherwise responded to pursuant to KRS 82.615 within seven days after the citation.
(a) The maximum civil fine required by KRS 65.8808(2)(b)(1) that may be imposed for each separate violation of any provision this chapter is hereby established as $500 for a first violation, $750 for a second occurrence of the same violation and $1,000 for the third and each subsequent occurrence of the same violation, plus the costs of collection, including, without limitation, court costs and attorney fees; and
(b) The specific civil fine required by KRS 65.8808(2)(b)(2)that may be imposed for each separate violation of any provision of this chapter is hereby established as $100 for a first violation, $250 for a second occurrence of the same violation and $500for the third and each subsequent occurrence of the same violation, plus the costs of collection, including, without limitation, court costs and attorney fees.
(B) Criminal penalty. Nobody shall conspire, cause, permit, promote, allow, aid, assist, encourage, or engage in any violation of any provision of this chapter; and, pursuant to the authority of KRS 83A.065, each and every violation thereof, by either act or omission, is hereby designated and declared to be a misdemeanor; and each day of any continuation thereof shall be a separate and distinct violation and offense, for which everybody convicted thereof in a court of competent jurisdiction shall be sentenced to pay a criminal fine not to exceed the maximum amount of $500 as set forth in KRS 534.050(2)(a) or a term of imprisonment not to exceed the maximum period of 12 months as set forth in KRS 532.090(1), or both.
