For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ANYBODY. Any human being, or any organization or combination thereof, in the form of a corporation, partnership, joint venture, unincorporated, associated or otherwise.
DIRECTOR OF PUBLIC WORKS. The Director of Public Works of the City of Erlanger.
EVERYBODY. Every human being, or any organization or combination thereof, in the form of a corporation, partnership, joint venture, unincorporated, associates or otherwise.
NEW DEVELOPMENT. A subdivision of land in the city for which a plat thereof has been approved by the county and municipal Planning and Zoning Commission and recorded with the County Clerk after the effective date of this subchapter.
NOBODY. No human being, or any organization or combination thereof, in the form of a corporation, partnership, joint venture, unincorporated, associated or otherwise.
STREET LIGHT.
(1) Any street light that is equal to or better than those provided by the Utility Provider to the customers thereof, which are thereby identified and referred to as “luminaries,” and which are more particularly described in the specifications therefor attached hereto and incorporated herein by reference.
(2) A light as hereinbefore defined that utilizes Light Emitting Diode (LED) technology, is provided and recognized by the Utility Provider and meets all applicable guidelines/recommendations in regards to light trespass, glare and color temperature for their designated use:
(a) Is energized by an electric current, that is part of the system provided by the Utility Provider, in a manner that provides maximum energy efficiency for approved luminaire;
(b) Emits a light with an intensity that is appropriate for use/location, meets the minimum recommendation of Utility Provider for use/location and is approved by Director of Public Works of the City of Erlanger;
(c) Is enclosed within a protective housing the meets all applicable regulations and guidelines regarding LED luminaires, with the style and design recommended by the Utility Provider and approved by the Director of Public Works of the City of Erlanger; and
(d) Is on top of and supported by a pole system that meets or exceeds all applicable standards for the recommended/approved LED luminaire in regards to mounting height, pole type and strength.
SYSTEM OF NEW DEVELOPMENT STREET LIGHTS. A system of subdivision street lights in the public right-of-way, with at least one subdivision street light at each street cul-de-sac and each intersection of streets.
