2-2-1: CREATION AND MEMBERSHIP:
A board of appeals is hereby authorized to be established. The word "board" when used in this chapter shall be construed to mean the board of appeals. The said board shall consist of seven (7) members appointed by the president by and with the consent of the board of trustees. The members shall be appointed for successive six (6) year terms. One of the members of said board shall be designated by the president, with the consent of the board of trustees, as chairman of said board, and shall hold his said office as chairman until his successor is appointed. Such chairman, or in his absence the acting chairman, may administer oaths and compel the attendance of witnesses. The president shall have the power to remove any member of said board for cause and after a public hearing. Vacancies upon said board shall be filled for the unexpired term of the member whose place has become vacant, in the manner herein provided for the appointment of such member. (Ord. 215, 9-17-1962)
In cases where the board believes it to be in the best interest of the general public and in the event a meeting of the board cannot be held because of a lack of quorum of the members appointed by the president, the chairman or acting chairman may request that any or all trustees of the village board be permitted to act as an alternate member of the board for such meeting and shall have the authority for that meeting as a member of the board of appeals, including the right to vote and all other privileges accorded a regular member of the board of appeals. In addition to the seven (7) appointed members, the president shall also have the authority, with the consent of the board of trustees, to appoint not more than three (3) alternate members to the board (herein "alternates"). The chairman shall have the authority, in his or her sole discretion, if one of the seven (7) members of the board are not able for any reason to attend any meeting of the board, to request that an alternate attend such meeting and the alternate shall in such event have the same power and authority as the seven (7) members of the board of appeals, including the right to vote and all other privileges accorded a regular member of the board of appeals.
