8-6-2: REQUIREMENTS:
A person may operate a nonhighway vehicle on the village streets if the person and nonhighway vehicle comply with all the following requirements and conditions:
   (A)   All nonhighway vehicles shall be certified by the chief of police after inspection by a village designated representative. If the vehicle is certified by the chief, a permit shall be issued by the chief evidenced by a decal which shall be affixed to the rear of the vehicle.
   (B)   All permits shall expire on January 1 of each year, unless renewed.
   (C)   Comply with the published "Rules Concerning Operation Of Non-Highway Vehicles On Village Streets" as determined by the board of trustees.
   (D)   Must have current, valid driver's license issued to the operator.
   (E)   No nonhighway vehicles shall be operated on any village street unless equipped with all of the following in good operating condition:
      1.   Brakes and brake lights;
      2.   Turn signals;
      3.   Steering wheel apparatus;
      4.   Tires;
      5.   Rearview mirror;
      6.   "Slow moving vehicle" emblem on the rear of the vehicle as required by 625 Illinois Compiled Statutes 5/12-709;
      7.   Headlight that emits a white light visible from a distance of five hundred feet (500') to the front which will illuminate when in operation;
      8.   Taillamp that emits red light visible from at least one hundred feet (100') from the rear which must illuminate when in operation;
      9.   Red reflectorized warning devices on each rear side and one in the center rear of the vehicle.
   (F)   Comply with the mandatory insurance requirements under 625 Illinois Compiled Statutes 5/7-601 et seq.
   (G)   Any other applicable requirements of the code as may be amended from time to time.
   (H)   Yield to the right of way to all other vehicles and pedestrians at all times.
   (I)   Wear a seat belt if the nonhighway vehicle is equipped with a seat belt.
   (J)   Obey all traffic laws of the state of Illinois and the village of Erie.
   (K)   All operators of a nonhighway vehicle shall be eighteen (18) years of age or older.
   (L)   Operation is prohibited on sidewalks or village parks other than parking areas.
   (M)   A nonhighway vehicle may not be operated in excess of twenty five (25) miles per hour or the posted speed limit, whichever is lower.

   (O)   The operator and the nonhighway vehicle shall be subject to inspection by the chief of police or a representative of the police department at any time.
   (P)   A nonhighway vehicle shall not be operated during inclement weather or when visibility is impaired by weather, smoke, fog or other condition, or at any time when light is insufficient to clearly see persons or vehicles on the village streets at a distance of five hundred feet (500'), in an unsafe or reckless manner, or in violation of any provision of this chapter.
   (Q)   The operator and passengers shall not use or operate the vehicle in an unsafe manner as determined by the Erie Police Department. (Ord. 672, 12-11-2012; amd. Ord. 700, 9-13-2016; Ord. 736, 6-11-2019)
