8-1-1: DEFINITIONS:
ENCROACHMENT: Any building, fence, sign, or any other structure or object of any kind (with the exception of utilities and public road signs), which is placed, located or maintained in, on, or over any portion of the roadway right of way.
MOTOR VEHICLE: Whenever the term "motor vehicle" is used in this title, it shall be construed to include automobiles, motorcycles, tractors, traction engines and all other vehicles propelled otherwise than by muscular power, and including also vehicles or trailers, or semitrailers, pulled or towed by a motor vehicle, but excluding cars of electric and steam railways and other motor vehicles running only upon fixed rails or tracks, or propelled by electric power obtained from overhead trolley wires. Nothing in this title shall be construed to apply to or affect bicycles or tricycles or such other vehicles as are propelled exclusively by muscular pedal power, unless so indicated in the context herein.
ROADWAY RIGHT OF WAY: Those areas existing or acquired by dedication or by fee simply for highway purposes; also, the areas acquired by temporary easement during the time the easement is in effect.
STREET: Whenever the term "street" is used in this title it shall be construed to include streets, alleys and public highways of any and all descriptions. (Ord. 107, 8-13-1946; amd. Ord. 410, 3-13-1990)
