(a) For purposes of this section, an under speed vehicle is a four-wheeled motorized vehicle other than a truck that either is originally designed and constructed with a top attainable speed of twenty miles per hour or less, or is not originally designed and constructed for operation on a street or highway.
(b) No person shall operate an under speed vehicle on the streets permitted in the Village of Enon unless the under speed vehicle has been inspected by the Chief of Police for compliance with the State of Ohio’s statutory requirements that are applicable to motor vehicles.
(c) The owner of the under speed vehicle shall be required to pay an inspection fee of ten dollars ($10.00). If the Chief of Police determines that the under speed vehicle complies with the statutory requirements, the Chief of Police shall issue the owner a certificate of inspection entitling the owner to register, apply for title, and purchase license plates for the vehicle. The owner must also show the Chief of Police a valid Ohio operator’s license and proof of insurance for the under speed vehicle before the certificate of inspection can be issued.
(d) Under speed vehicles that have been inspected shall display a safety sticker provided by the inspector on the windshield of the vehicle.
(e) No person shall operate an under speed vehicle on any village street where the posted speed limit exceeds thirty-five miles per hour, except when crossing such roadway is necessary to comply with this section. No person shall operate an under speed vehicle on any sidewalk or leisure path.
(f) Whoever violates this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense after the second offense, the person is guilty of a misdemeanor of the third degree.
