All violations of this Chapter are civil violations, punishable in accordance with the following provisions:
A. Civil Fine. Failure to strictly comply with any part, provision or section of this Chapter, any Permit, Camping Permit or Vehicle Permit or any other rules, regulations, requirements or administrative provisions, process or procedures adopted by the Town Commissioners shall be considered a civil code violation punishable by fine as follows:
1. First violation a civil fine of no more than one hundred dollars ($100.00);
2. Second violation a civil fine of no less than one hundred dollars ($100.00) and no more than two-hundred fifty dollars ($250.00);
3. Third and subsequent violation a civil fine of no less than five hundred dollars ($500.00) per violation.
B. Payment Means. Prior to imposing any fine for violation of this Chapter, the Court shall make an inquiry into a person's ability to pay. In lieu of any civil fine the Court may order the person to perform community service. (Ord. 153, 12-8-2022; amd. Ord. 155-2023, 7-27-2023)
