Any peace officer or town marshal shall, upon apprehending any juvenile shooting, using or employing a BB or other character of compressed air gun, immediately confiscate the same and shall hold the same as evidence until any criminal action in relation thereto is completed; and provided further, that the same shall not be redelivered to a person under the age of eighteen (18) years but only to the parent or guardian of such person under eighteen (18) years of age.
