10-6-1: SIDEWALKS REQUIRED:
   A.   Definitions: For the purposes of this section, the following definitions shall apply:
   ADDITION: Construction of a structure that is attached to or connected with an existing building.
   COMMUNITY CENTERS AND NEIGHBORHOOD CENTERS: As defined in the Envision Enid Comprehensive Plan, § 6-1. The size of a Community or Neighborhood Center is determined by the width of the commercial, industrial or special use zoning from the intersection.
   DITCH: An earthen channel typically used for drainage along the side of a road or street.
   INFILL DEVELOPMENT: The development of a previously undeveloped lot or tract of land in an existing neighborhood.
   NATURAL DISASTER: An event or force of nature, including, fire, earthquake, flood and tornado.
   NEW DEVELOPMENT: Improving an undeveloped lot or tract of land by subdividing, site planning, construction or building permitting. Development on a previously developed lot or tract of land which where the previous development is removed for the purposes of developing the site shall also be considered new development.
   REDEVELOPMENT: The development of a previously developed lot or tract of land after a total loss.
   TOTAL LOSS: The destruction of a structure as a result of a natural disaster such that nothing of value remains and the structure cannot be repaired or restored to its original condition.
   B.   Residential Sidewalks That Parallel Abutting Streets: The following shall include sidewalks that parallel all abutting streets:
      1.   New development.
      2.   Redevelopment or infill development on property used or zoned as residential (four-family R-4A, townhouse R-5, multi-family R-7).
      3.   Redevelopment or infill development on property used or zoned as residential (estate R-1, single-family R-2, mobile home neighborhood R-3, duplex R-4), but only if an adjacent property or if a property within the same residential subdivision has a sidewalk.
   C.   Commercial, Industrial, or Special Use Properties: For new developments, additions, redevelopments, and infill developments, sidewalks that parallel abutting streets, shall be the length of the lot or development, whichever is less, and will be included in the following locations:
      1.   Within ETS Enid Town Square Overlay District Boundaries, as set out in Section 11-10C-3 of this Code.
      2.   Within a Community Center at:
         a.   Willow Road and Cleveland Street,
         b.   Willow Road and Van Buren Street,
         c.   Owen K. Garriott and Garland Road,
         d.   Owen K. Garriott and Cleveland Street, and,
         e.   Rupe Avenue and Van Buren Street.
      3.   Within a Neighborhood Center at:
         a.   Willow Road and Oakwood Road,
         b.   Willow Road and Grand Avenue,
         c.   Chestnut Avenue and Garland Road,
         d.   Chestnut Avenue and Oakwood Road,
         e.   Chestnut Avenue and Cleveland Street,
         f.   Chestnut Avenue and 10th Street,
         g.   Chestnut Avenue and 16th Street,
         h.   Randolph Avenue and Garland Road,
         i.   Randolph Avenue and Oakwood Road,
         j.   Randolph Avenue and 30th Street,
         k.   Broadway Avenue and 10th Street,
         l.   Broadway Avenue and 16th Street,
         m.   Broadway Avenue and University Avenue,
         n.   Owen K Garriott and Van Buren Street, and,
         o.   Owen K. Garriott and 10th Street.
      4.   Along these Streets:
         a.   Owen K, Garriott from Wheatridge Road to 16th Street;
         b.   Oakwood Road from a .25 mile north of Owen K. Garriott to .30 mile south of Owen K. Garriott,
         c.   Van Buren Street from Willow Road to Rupe Avenue,
         d.   Willow Road from Cleveland Street to Grand Avenue,
         e.   Grand Avenue from Willow Road to Elm Avenue,
         f.   30TH Street from Randolph to Oklahoma Avenue,
         g.   Randolph Avenue from Van Buren Street to 10th Street,
         h.   Broadway Avenue from Van Buren Street to 10th Street, and,
         i.   Maine Street from Van Buren Street to 10th Street.
   D.   Exceptions:
      1.   In a ditch if there is less than five feet between the back of the curb or driving surface and the top of the slope of the ditch, or if there is less than five feet between the top of the slope of the ditch and the limits of the right of way, or a ditch with a slope greater than 1:3.
      2.   Placement or construction of an accessory building.
      3.   Addition, new development, redevelopment, or infill development on agriculturally zoned land.
      4.   Remodels, maintenance of buildings, or after a total loss.
      5.   Additions that do not exceed two thousand five hundred (2,500) square feet. (Ord. 2016-03, 2-2-2016; amd. Ord. 2019-23, 9-24-2019)
