CITY: The city of Enid, Oklahoma, a municipal corporation.
CONSUMER: Any individual person, corporation, company, partnership, firm, unincorporated association, trust, or public corporation who uses or consumes natural gas in the city but does not include self-suppliers of natural gas.
FRANCHISEE: Oklahoma Natural Gas Company or any other entity holding a valid franchise from the city for the transportation, distribution or sale of gas.
LICENSE: The rights and privileges granted by the city manager on behalf of the city of Enid to a consumer to use the public ways for the transportation of natural gas as provided by this chapter.
LICENSEE: A consumer granted a license under this chapter.
PIPELINE SYSTEM: A system of works, pipes, pipelines, apparatus, machinery, structures, appliances and appurtenances located within the public ways reasonably necessary for the transportation, distribution, or sale of natural gas.
PUBLIC WAYS: Any street, alley, avenues, boulevard, lane, park, parkway, sidewalk, driveway, utility easement, right of way, and any other public ways, places, areas, or grounds within the corporate limits of the city of Enid as now constituted or may be added hereafter.
SETTLEMENT PRICE: The inside FERC first of the month price for natural gas as published for the month of delivery in the "Platts Inside FERC Gas Market Report" publication, under the heading "Prices Of Spot Gas Delivered To Pipelines", Oneok Gas Transportation, LLC - Oklahoma, or a successor publication or index.
TRANSPORT GAS: All natural gas transported and/or distributed by the franchisee, but not sold by the franchisee, through the pipeline system to any consumer located within the corporate limits of the city of Enid.
VOLUMETRIC RATE: That sum measured in cents per dekatherm "Dth" in accordance with the provisions of section 8-6-3 of this chapter. The volumetric rate calculation shall be based on the settlement price for the month of delivery and multiplied by three percent (3%) to obtain the volumetric rate for that month.
