§ 7-1A-2 STREET CONSTRUCTION PERMIT.
   (A)   Permit required; exceptions.
      (1)   Required. No person shall lay, place, construct, alter, repair, remove or maintain any concrete, asphalt, hard surfacing, pipe, wire, poles, lines or other material of any kind or do any ditching, excavating or filling in any street, alley or public easement in the City without first having obtained a permit from the City Engineer. This provision applies to all persons, including, but not limited to, franchisees and license holders.
      (2)   Exceptions. No permit is required:
         (a)   When work is done by or for the City; or
         (b)   For the fencing in of any utility easement or the growing of shrubs thereon.
   (B)   Application for permit. Application for such permit shall be accompanied by detailed plans and specifications of the work to be done.
   (C)   Permit fee; exceptions.
      (1)   If the plans and specifications comply with the requirements of this article, the Engineering Department shall issue the permit upon payment of a fee as specified in § 2-6A-7(C) to the Director of Finance.
      (2)   No fee shall be required for:
         (a)   Persons authorized to do such work by the state or by a franchise granted by the City; or
         (b)   Work other than street concrete work.
