1-13-2: DEFINITIONS:
The following words and phrases when used in this chapter, shall for the purposes of this chapter, have the meanings respectively ascribed to them in this section, except where the context otherwise requires:
CONFIDENTIAL EMPLOYEES: All employees of the city manager's office, all employees of the city attorney's office (including the court clerks), all employees of the human resources office, all employees of the payroll office, all employees of the IT department, and one secretarial or clerical employee designated by each department head.
DAY: A calendar day, except that when a limited time period specified in this chapter ends on a Saturday, Sunday, or recognized city holiday, the limited time period shall be extended to the next workday of the employer's administrative offices.
DIRECT ECONOMIC ISSUES: Salaries, wages, rates of pay, or other fringe benefits, which require the appropriation of monies by the mayor and board of commissioners.
EMPLOYEE: A full time employee of the city, but does not include, for the purposes of exclusive recognition, a management official, a supervisor, a confidential employee, a management/confidential employee, an employee engaged in the administration of this chapter, police officers, or firefighters, or a temporary or seasonal employee hired for a time certain of less than six (6) months during a fiscal year.
EMPLOYER: The city manager.
LABOR ORGANIZATION: A lawful organization of any kind in which employees participate and which exists for the purpose, in whole or in part, of dealing with employers concerning compensation, hours, grievances, and other terms and conditions of employment, but does not include an organization which:
   A.   Assists or participates in a strike against the city or imposes a duty or obligation to conduct, assist, or participate in such a strike;
   B.   Advocates the overthrow of the constitutional form of government of the United States, or any political subdivision thereof;
   C.   Discriminates with regard to the terms or conditions of membership because of race, color, creed, sex, age, or national origin.
MANAGEMENT/CONFIDENTIAL EMPLOYEE: This category shall include all executive employees and professional employees.
MANAGEMENT OFFICIAL: This category shall include all directors, department heads and other FLSA exempt personnel.
STRIKE: Any work stoppage or slowdown or other behavior by an employee who, individually or by concerted action with others and without the approval of his superior, wilfully absents himself from his position or abstains in whole or in part from the full, faithful, and proper performance of his duties for the purpose of inducing, influencing, or coercing a change in conditions or compensation, or the rights, privileges, or obligations of employment.
SUPERVISOR: An employee having the authority, in the interest of the employer, to do one of the following: transfer, suspend, lay off, recall, promote, discharge, assign, reward, or discipline other employees or responsibly to direct them, or to adjust their grievances, if in connection with the foregoing the exercise of authority is not of a mere routine or clerical nature, but requires the use of independent judgment. Examples of supervisory positions include, but are not limited to, the following: animal control manager, CIC assistant manager, librarian, assistant supervisor, landfill manager, court clerk, planning administrator, civil engineer, records supervisor, 911 supervisors, and juvenile and community services manager.
