ORDINANCE NO. 2024-02
 
AN ORDINANCE AMENDING THE ENID MUNICIPAL CODE, 2014, TITLE 5, “PUBLIC SAFETY”, CHAPTER 7 “ANIMAL WELFARE”; TO AMEND SECTION 5-7-16 “POTBELLIED PIGS” TO AMEND THE DEFINITION OF POTBELLIED PIG AND TO ALLOW A VETERINARIAN’S CERTIFICATION FOR PET PIGS OVER ONE HUNDRED POUNDS PROVIDING FOR REPEALER, SAVINGS CLAUSE, SEVERABILITY AND CODIFICATION.
ORDINANCE
BE IT ORDAINED BY THE MAYOR AND BOARD OF COMMISSIONERS OF THE CITY OF ENID, OKLAHOMA:
 
Section I: That Title 5, Chapter 7, Section 5-7-16 is hereby amended to read:
 
5-7-16: POTBELLIED PIGS:
 
   A.   Potbellied pigs may be kept as pets within the city limits of the city if the pigs are kept as pets for personal enjoyment and not raised for human consumption.
 
B. The Pigs that are not more than shall not exceed seventy-five pounds in weight one hundred pounds or more than twenty inches in height, are presumed to be potbellied pigs. For adult pigs that exceed one hundred pounds or twenty inches in height, a veterinarian’s certification that the pig is a pet and is not raised for human consumption is required for the pig to be classified as a potbellied pig.  
 
C. The number of potbellied pigs is limited to two adult pigs per household.
 
  D.  Violation: The violation of this section shall be punishable by one hundred dollars fine.
 
Section II:   Repealer. All ordinances or parts thereof, which are inconsistent with this ordinance are hereby repealed, specifically Title 5, Chapter 5, Article A §§5-7A-1 through 5-7A-7 are is repealed.
 
Section III:   Savings Clause. Nothing in this ordinance hereby adopted shall be construed to affect any suit or proceedings now pending in any court, or any rights acquired or liability incurred, nor any cause or causes of action accrued or existing, under any act or ordinance repealed hereby. Nor shall any right or remedy of any character be lost, impaired or affected by this ordinance.
 
Section IV:   Severability. If any one or more of the sections, sentences, clauses or part of this ordinance, chapter or section shall, for any reason, be held invalid, the invalidity of such section, clause or part shall not affect or prejudice in any way the applicability and validity of any other provision of this ordinance. It is hereby declared to be the intention of the City Commission of the City of Enid that this section of the Enid Municipal Code would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part not been included.
 
Section V:   Codification. This ordinance shall be codified as Title 5, Chapter 5, Sections 5-7-16 of Enid Municipal Code 2014.
