3-3-3: LICENSE REQUIRED; VIOLATION:
   A.   License Required: No person shall operate a food service establishment within the City without first obtaining the appropriate business license pursuant to the provisions of this chapter.
   B.   Scope Of Regulations: The scope of these regulations are to protect the general public as to food and drink in which reasonable persons would assume the products would be prepared at licensed facilities by trained personnel. The regulations do not cover bake sales to raise money for charitable causes, baked goods labeled as required by State Statute, lemonade stands run by juveniles, or pot lucks. These are traditional cultural activities that the public participates in with no expectation of food quality or safety.
   C.   Violation: Operation of a food service establishment without the appropriate business license shall be punishable by up to sixty (60) days' imprisonment and/or a fine of up to five hundred dollars ($500.00) plus court costs and fees. Each day during which a violation is committed, continued or permitted shall be deemed a separate offense. (Ord. 2019-06, 4-16-2019)
