12-2-2: FINAL PLAT:
   A.   Scope: The final plat will have incorporated all changes or modifications required by the planning commission; otherwise it shall conform to the preliminary plat, and it may constitute only that portion of the approved preliminary plat which the subdivider proposes to record and develop at the time; provided, that such portion conforms with all the requirements of this section.
   B.   Preparation: The final plat shall be prepared by a registered engineer or licensed land surveyor registered in the state of Oklahoma.
   C.   Filing:
      1.   Required Matter: After receiving notice of the action of the planning commission approving the preliminary plat, the subdivider shall proceed to file with the community development department:
         a.   Copies of the final plat in the amount required by the planning administrator.
         b.   A written application for final approval.
         c.   Construction plans; cross sections and profiles of streets, and all other construction drawings related to water and sewer improvements to be constructed in the subdivision.
      2.   Time Limits:
         a.   The first final plat of a subdivision shall be filed not later than one year after the date of approval of the preliminary plat; otherwise it will be considered void unless an extension is requested in writing by the subdivider and for good cause granted by the planning commission.
         b.   The final plat and accompanying plans shall be filed at least fourteen (14) days prior to the meeting at which it is to be considered. The final plat shall be considered officially filed when it is received by the planning administrator, and is found to be in general compliance with the provisions of this title.
   D.   Review And Approval:
      1.   Review Process: Cross sections, profiles and other construction drawings shall be forwarded by the community development department to the appropriate city department for study and recommendations. The department shall, within two (2) days after the filing of the final plat, transmit copies of the plat for their study and recommendation to the:
         a.   Director of engineering services.
         b.   Public works director.
         c.   Public utilities director.
         d.   ADA compliance and risk management coordinator.
         e.   Each company or agency furnishing electric, gas, telephone and cable service.
         f.   Such other official body, company or agency as may be directed by the planning commission.
      2.   Resubmittal: After receiving a written report from each city official, company or agency enumerated in subsection D1 of this section, the planning administrator shall notify the subdivider of any recommended changes or suggestions so that the subdivider may correct the final plat and submit same for final approval.
      3.   Time Requirements: The final plat shall then be resubmitted prior to the meeting at which the plan is to be considered by the planning commission. The planning commission shall act on the final plat within sixty (60) days after filing, unless such time is extended by agreement with the subdivider or his agent. If no action is taken by the planning commission within said sixty (60) days after filing, or such longer period as may have been agreed upon, the final plat shall be deemed approved, and it shall be the duty of the planning commission chairman to comply with subsection D4a of this section.
      4.   Notice Of Action Taken: The planning commission shall determine whether the final plat shall be approved or disapproved and shall give notice to the subdivider in the following manner:
         a.   If approved, the planning commission chairman shall affix his signature to the plat and attach thereto a notation that it has received final approval and return it to the community development department for submission to the mayor and board of commissioners.
         b.   If disapproved, the secretary of the planning commission shall attach to the plat a statement of the reasons for such action and return it to the community development department for submission to the mayor and board of commissioners.
         c.   In any case, a notation of the action taken, and the requisite reasons therefor, shall be entered in the records of the planning commission, and the records and plat submitted to the mayor and board of commissioners for consideration.
      5.   Recording: Within six (6) months after approval of the final plat by the city, the subdivider shall record it in the office of the county clerk of Garfield County, Oklahoma; otherwise the final plat shall be considered void. (Ord. 2009-09, 4-7-2009)
