1448.99 PENALTY; EQUITABLE REMEDIES.
   Whoever violates any of the provisions of this chapter or fails to comply with any of its requirements or erects, constructs, alters or repairs, or does any work upon or in connection with, any building or structure in violation of a plan therefor or directly relating thereto, approved or made by the proper officer of this Municipality or under a certificate issued by this Municipality, is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1, 000) or imprisoned not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation or failure occurs or continues, except that imprisonment shall not exceed six months in connection with any particular such violation or failure, regardless of the length of its continuance.
   The imposition of any criminal penalty shall not preclude the appropriate official provided for in this chapter from also instituting an appropriate action in a court of proper jurisdiction to prevent an unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance or use, or to restrain, correct or abate a violation of this chapter, or to prevent illegal action, business or use in or about any premises, or to require compliance with provisions of this chapter or any other applicable ordinances, rules or regulations of this Municipality or the orders or determinations of the Code Enforcement Officer and other responsible officers and boards of this Municipality, including the Administrative Board for Planning and Zoning Appeals.
