(a) Pursuant to Section 2.13 of the City Charter, there is hereby adopted, insofar as it is not inconsistent with the laws of the State and the ordinances of the City, for the purpose of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, including permits and penalties, that certain building code known as the 2019 Residential Code of Ohio for One, Two and Three Family Dwellings, with errata and additional changes, hereinafter referred to as the “Ohio Residential Code,” save and except such portions as are hereinafter modified or deleted. Such Code, as amended, is hereby incorporated in this chapter by reference as fully as if set out at length herein and shall be controlling in the construction of all residential buildings and accessory structures in the City.
(b) The established appeals process to hear and decide appeals of orders, decisions, or determinations made using this code, through the Montgomery County Building Regulations Department, shall be continued.
