1242.15 VARIANCES AND APPEALS.
   When a subdivider can show that a provision of these Regulations would cause unnecessary hardship if strictly adhered to and when, in the opinion of the Planning Commission, because of topographical or other conditions peculiar to the site, a variance may be allowed without destroying the intent of such provision, the Commission may recommend a variance to the Board of Appeals. The subdivider shall apply in writing to the Board, stating the reasoning on which the departure is based, and his or her application shall be processed by the Board in accordance with the procedures outlined in Section 1242.03. Any variance authorized by the Board shall be made by resolution and a copy thereof shall be attached to, and made a part of, the final plat. In granting variances, the Commission may require such conditions as are necessary to adhere to the intent of these Regulations.
