1054.01 DEFINITIONS.
   Unless the context indicates otherwise, as used in this chapter:
      (1)   "Act" means the Federal Clean Water Act, as amended, 33 U.S.C. 1261 et seq.
      (2)   "BOD" (denoting biochemical oxygen demand) means the quantity of oxygen used in biochemical oxidation under standard laboratory procedure in five days at twenty degrees Celsius, expressed in milligrams per liter, as stipulated in 40 CFR, Part 136. When the BOD test is not practical, the COD test may be used to determine the BOD by applying an appropriate factor on a case-by-case basis.
      (3)   "COD" (denoting chemical oxygen demand) means a measure of the oxygen equivalent of a sample that is susceptible to oxidation by a strong chemical oxidant. COD is determined by standard laboratory procedure as stipulated in 40 CFR, Part 136.
      (4)   "Day" means the twenty-four hour period beginning at 12:01 a.m.
      (5)   "Director" means the Director of Service for the City or an authorized designee.
      (6)   "EPA" means the United States Environmental Protection Agency.
      (7)   "Existing industrial user" means any industrial user discharging into the City's wastewater facility on the date of enactment of this chapter
(Ordinance 86-4, passed May 6,1986).
      (8)   "Existing user" means any user discharging into the City's wastewater facility on such date of enactment.
      (9)   "Garbage" means the solid animal and vegetable wastes resulting from domestic or commercial handling, storage, dispensing, preparation, cooking and serving of food.
      (10)   "Interference" means any inhibition or disruption of the City's wastewater facility, its treatment processes or operations or its sludge processes or disposal, which inhibition or disruption is a cause, in whole or in part, of a violation of any requirement of the City's NPDES permit (including an increase in the magnitude or duration of a violation), or of the prevention of sewage sludge use or disposal by the City in accordance with the following statutory provisions and regulations: Section 405 of the Clean Water Act, the Solid Waste Disposal Act (SWDA) (including Title II, more commonly referred to as the Resource Conservation and Recovery Act (RCRA)), as amended, and including State regulations contained in any State sludge management plan prepared pursuant to Subtitle D of the SWDA, the Clean Air Act and the Toxic Substances Control Act.
      (11)   "New industrial user" means an industrial user not connected to the City's wastewater facility on the original date of enactment of this chapter (Ordinance 86-4, passed May 6, 1986).
      (12)   "New user" means any user not connected to the City's wastewater facility on such date of enactment.
      (13)   "NPDES" means the National Pollutant Discharge Elimination System permit program, whether administered by the U.S. EPA or by the Ohio EPA.
      (14)   "NPDES permit" or "permit" means a permit issued to a publicly owned treatment works (POTW) pursuant to Section 402(b) of the Act or its State equivalent.
      (15)   "Pass-through" means any discharge of pollutants through the City's wastewater facility into navigable waters in quantities or concentrations which are a cause, in whole or in part, of a violation of any requirement of the City's NPDES permit. This includes, but is not limited to, an increase in the magnitude or duration of a violation.
      (16)   "Person" means any individual, film, company, association, society, partnership, corporation, municipality, other similar organization or governmental agency or other agencies or groups, including users of the wastewater facility.
      (17)   "pH" means the logarithm of the reciprocal of the hydrogen ion concentration expressed in moles per liter of solution as determined by the method identified in 40 CFR, Part 136.
      (18)   "Pretreatment" means the reduction of the amount of pollutants, the elimination of pollutants or the alteration of the nature of pollutant properties in wastewater prior to discharge to the City's wastewater facility.
      (19)   "Pretreatment standard" means any regulation containing pollutant discharge limits promulgated by the EPA in accordance with Sections 307(b) and (c) of the Act, which regulation applies to nonresidential users, or any other such standard promulgated by the City or the State.
      (20)   "Properly shredded garbage" means garbage that has been shredded to such a degree that all particles will be carried freely under flow conditions normally prevailing in the wastewater sewers, with no particle greater than one-half inch in any dimension.
      (21)   "Publicly owned treatment works" or "POTW' means a treatment works (wastewater treatment facility), as defined by Section 212 of the Act, which is owned by a state or municipality.
      (22)   "Residential user" means all premises used only for human residency and which are connected to the City's wastewater facility.
      (23)   "Shall" is mandatory; "may" is permissive.
      (24)   "Slugload" means any substance or pollutant released in a wastewater discharge at a rate and/or concentration which causes interference to and/or which will pass through a wastewater treatment facility.
      (25)   "Suspended solids" means the total suspended matter that either floats on the surface of or is suspended in water or wastewater, as determined by the method identified in 40 CFR, Part 136.
      (26)   "TTO" (denoting total toxic organics) means the summation of all quantifiable values greater than 0.01 milligrams per liter for the organics listed in Appendix I following the text of this chapter.
      (27)   "User" means any nonresidential facility which discharges wastewater to the City's wastewater facility.
      (28)   "Wastewater" means sanitary sewage, industrial wastes and water-carried wastes from residences, commercial buildings, industries and institutions, together with any ground water, surface water or storm water that may be introduced into the City's wastewater facility.
      (29)   "Wastewater Discharge Permit" or "Industrial Discharge Permit" means a formal permit to discharge industrial waste into the POTW, as issued by the City.
      (30)   "Wastewater facility" means the combination of the City's wastewater sewers and wastewater treatment facility.
      (31)   "Wastewater sewer" or "sanitary sewer" means the structures, processes, equipment, piping and arrangements necessary to collect and transport wastewater to the wastewater treatment facility.
      (32)   "Wastewater treatment facility" means the structures, land, processes, equipment and arrangements necessary for the City to treat and discharge wastewater.
