1040.01 DEFINITIONS.

   As used in this Title Four:

   (a)   Words denoting the masculine gender include the feminine and neuter genders. (b) Words in the singular include the plural, and words in the plural include the singular.

   (c)   General terms following specific enumeration of terms are not to be limited to the class enumerated unless expressly so limited.

   (d)   "And" or "or" includes the other as if written "and/or. "

   (e)   "City" means the City of Englewood, in Montgomery County, Ohio.

   (f)   "Water system" and "sewer system" mean the water and sewer systems owned and operated by the City and all parts thereof respectively.

   (g)   "Person" and "whoever" includes a natural person, partnership or a corporate body, or any body of persons corporate or incorporate.

   (h)   "Person" or "whoever," as applied to any unincorporated entity, means the partners or members thereof and as applied to corporations, the officers thereof when used in any clause prescribing and imposing a penalty.

   (i)   "Month" means a calendar month.

   (j)   "Council" means the Council of the City of Englewood.

   (k)   "Property" includes real and personal property.

   (l)   "Personal property" includes every species of property except real property.

   (m)    "Real property" includes lands, tenements and hereditaments and embraces all chattels real.

   (n)   "Owner, " as applied to a building or land, includes any part owner, joint owner, tenant, tenant in common, tenant in partnership, joint tenant of the whole or a part of such building or land, either alone or with others.

   (o)   "Approved" means accepted or acceptable for the proposed use by the appropriate administrative official.

   (p)   "Consumer" or "user" means any person to whom water from the water system is delivered or who discharges sewage into the sewer system.

   (q)   "Connection" and "connection tap" means the union and the right to such union of the water or sewer system and an owner's or consumer's property.

   (r)   "Water service" means the delivery of water from the water system to an owner or consumer.

   (s)   "Sewer service" means the collection of sewage from an owner's or consumer's premises.

   (t)   "Adjusted rates" means those charges for water and sewer service established by the Finance Director as provided herein.

   (u)   "Base rates" means those charges for water and sewer service provided in Chapters 1044 and 1052.

   (v)   "Commodity charges" means the charges for water and sewer service for water use of over 5,000 gallons bimonthly provided for in Chapters 1044 and 1052 or those established by the Finance Director.

   (w)   "Minimum charges" means the charges for water and sewer service for water use of less than 5,000 gallons bimonthly provided for in Chapters 1044 and 1052 or those established by the Finance Director.
