1020.09 POLICY CONCERNING ROADWAY IMPROVEMENTS.
   (a)   It is hereby reaffirmed, declared and established that the policy of the City in cases of improving, constructing or rebuilding public roadways, shall be that the abutting or other benefiting property owner shall be required to financially participate in the improvement through an assessment in a proportion as determined by the City Engineer. This assessment may be waived if the property owner decides, with the approval of the City Engineer, to dedicate the needed right of way to accommodate the road project in lieu of the payment of an assessment.
   (b)   If the needed right of way is available but improvements are lacking, the property owner shall be assessed for curbs, gutters, sidewalks and drive aprons.
   (c)   The City Engineer may, at his or her discretion, delete some improvements when it is determined that the installation is impractical.
   (d)   It is further declared to be the policy of this City that the abutting or other benefiting property owner shall, at a minimum, be assessed for all costs of installing curbs, gutters, sidewalks and drive aprons across the entire length of his or her property, and the costs associated with the installation of these improvements, including, but not limited to, a proportionate share of contractual engineering, base material, survey staking, newspaper advertisements, restoration, grading, retaining walls, removing or relocating utility services, utility poles, bushes, trees and valve boxes, administrative costs and legal fees.
