1020.05 PERMIT CONDITIONS.
   The conditions upon which permits may be granted by the Director of Service and which shall be included in the application for a license or privilege and the contract granting the same, shall be as follows:
   (a)   The license or privilege may be revoked at any time by the City Manager, except such licenses or privileges as are granted to a utility company for the construction, installation, maintenance and use of an underground network, transformer vaults, manholes and handholes within or under a street, sidewalk, sidewalk space, alley, public way or place in the City, and excepting such licenses or privileges as may be granted to the United States Government, which licenses and privileges may be granted or issued to the United States Government without payment of the fees provided above and which licenses or privileges shall not contain any provision for revocation.
   (b)   All laws of the State and the ordinances of the City shall be obeyed by the grantee of such permits.
   (c)   The acts and the things done under the permit shall be subject to the supervision and control of the Director.
   (d)   All construction and improvements pertaining to building shall comply with requirements of the Montgomery County Uniform Building Code.
   (e)   The street, sidewalk, sidewalk space, alley, public way or place shall be restored within a certain specified time, which time in all cases shall be fixed at the discretion of the Director.
   (f)   Such street, sidewalk, sidewalk space, alley, public way or place shall be restored in accordance with the "Standard Drawings of the Southwest Ohio Engineering Association, " as adopted in Chapter 1424 of Part Fourteen - the Building and Housing Code. Copies of such Standard Drawings are available at the office of the Director of Service.
   (g)   The grantee of such privilege shall assume and pay any and all expense for such restoration of the street, sidewalk, sidewalk space, alley, public way or place or in any other manner arising out of or incident to the granting or exercise of such license or privilege which shall be at the sole risk of the grantee.
   (h)   The grantee will see to and be responsible for the safeguarding of all excavations and obstructions in any street, sidewalk, sidewalk space, alley, public way or place by placing and maintaining barricades about the same, and, in addition thereto, warning lights during the nighttime.
   (i)   The grantee or grantees, his or her heirs, successors or assigns, shall save the City free from any and all liability for damages to persons or property in any way connected with or arising out of or incident to the granting and exercise of such privilege, and will pay all expenses for any change in such privilege incident to any improvement or change of grade in any street, sidewalk, sidewalk space, alley, public way or place rendering such change necessary, and shall not make any claim for damages therefor against the City.
