858.99 PENALTY.

(a) Whoever violates Section 858.02(a) shall be guilty of a misdemeanor of the first degree. Anyone who has previously been convicted of or pleaded guilty to an offense under this section shall be guilty of a misdemeanor of the first degree, and shall serve no less than thirty days in jail.

(b) Whoever violates Section 858.09(a) shall be guilty of a minor misdemeanor.
