660.12 FENCES.
   (a)   No person shall erect or maintain any fence charged with electric power.
   (b)   No person, except as permitted herein, shall erect or maintain a barbed wire fence which abuts or is adjacent to a public street or sidewalk or, except as permitted herein, erect or maintain a partition fence from barbed wire. This division does not apply to the erection and maintenance of not more than three strands of barbed wire on top of a fence other than a barbed wire fence, provided that such strands are not less than seventy-two inches from the ground, nor does this subsection apply to the erection and maintenance of barbed wire fences on land used in a bona fide agricultural use.

   (c)   Whoever violates any of the provisions of this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. The penalty shall be as provided in Section 698.02.
