412.06 PARADES AND PROCESSIONS.
   (a)   Definitions. As used in this section:
      (1)   "Parade" means a group of vehicles, animals and/or people in a formation, or an assemblage moving along streets, the intent of which is to call attention to themselves, their vehicles or their animals, or to some message they proclaim, the travel through the streets and attention being the sine qua non of the group or its leaders.
      (2)   "Procession" means a group of vehicles with people in a formation or assemblage moving along streets, the prime intent thereof being to move to a certain destination and the leaders or persons therein having either no intent or only a secondary and small intent of calling attention to themselves, as a typical wedding or funeral procession. The provisions of this section shall not apply to such processions.

   (b)   Permit. A permit shall be required for all parades such permit to be issued by the Director of Police, without fee, and subject to the following regulations:
      (1)   An application for a parade permit must be made at the Municipal Building on forms supplied there at least one week before the day of the intended parade.
      (2)   The requirement that the application be made one week before the parade may be waived by the Director of Police for good cause shown provided that the Police Department can assure reasonable safety and convenience for the people in the parade and for the people not in the parade.
      (3)   The application for the parade must state the route to be followed and the time the parade is to start and finish. If the parade is to traverse a route longer than one mile, the time when the parade will arrive at intermediate points must be stated to the satisfaction of the Director of Police.
      (4)   One copy of the parade permit will be issued to the leader or group requesting the same and will have printed thereon the regulations concerning parades as set forth in this section.
      (5)   A permit to hold a parade may be denied if, in the opinion of the Director of Police, the parade would jeopardize the health, safety or welfare of residents of the Municipality or other persons present therein. In such case the applicant for the parade permit may appeal such decision to Council at its next scheduled meeting.

   (c)   Noise Regulations. Any parade will be subject to the following regulations as to noise:
      (1)   If vehicles owned and/or operated by the Municipality are provided to lead or follow the parade, and are driven by employees of the Municipality, such vehicles may use sirens and horns to warn or advise of the approach or passing of the parade.
      (2)   Other vehicles in the parade and other persons in the parade may not use sirens, horns, bells or other unusual noise-making devices, except as otherwise stated, in residential districts through which the parade traverses.
      (3)   Loudspeakers with voice reproduction, singing and music, and music supplied by bands and/or assemblages of persons, may be employed in any area. However, the Director of Police or his or her designated officer may require those in the parade to abate such noise in the vicinity of nursing homes, hospitals or other places within the Municipality where the making of such noise would be a nuisance.
   (d)   Other Regulations.
      (1)   No person shall hold a parade without obtaining the required permit and no person shall take part in a parade unless the required permit is issued therefor.
      (2)   No person shall hold or take part in a parade which follows a different route than authorized or which is held at a different or longer time than authorized by permit.
      (3)   All persons taking part in a parade shall obey all orders of the police in directing the parade.
