PREFACE
This City Code of the City of Emmett, as supplemented, contains ordinances up to and including ordinance O2018-08, passed September 25, 2018. Ordinances of the City adopted after said ordinance supersede the provisions of this City Code to the extent that they are in conflict or inconsistent therewith. Consult the City office in order to ascertain whether any particular provision of the Code has been amended, superseded or repealed.

Village of Emmett.   ) October 9, 1900
   It appearing that a majority of the taxable inhabitants of the territory described in said petition and hereinafter described have signed said petition;
   And it appearing that there are two hundred actual residents in said
territory; It is hereby ordered that the territory, beginning at the Southwest corner of the Northeast one-fourth of Section seven of Township six North and Range one West of B.M., thence running West one-fourth of a mile, thence North to the Payette River, thence following the river to the North line of Section seven, thence following said Section line East to where it would intersect the East line of the Emmettsville townsite were it continued, thence South along the East line of the townsite to a point four hundred ten feet South of the Southeast corner of the townsite, thence West to a North and South line passing through the point of beginning; thence North along said line to the point of beginning, be and the same is hereby declared to be incorporated as a village under the laws of the State of Idaho, and to be known hereafter as The Village of Emmett, as provided in said petition hereinbefore referred to.
   It is hereby further ordered that John McNish, W. R. Cartwright, C. P. Bilderback, E. K. Hayes and George E. Little, be and the same are hereby appointed as trustees of said incorporation to serve until their successors are elected and qualified.

   RESOLUTION OF INCORPORATION
   AS CITY OF THE SECOND CLASS
   WHEREAS, It appearing to this Board that the Village of Emmett,
Idaho, by a resolution legally adopted and published, which is as follows:
A Resolution Declaring the Village of Emmett, Canyon County, State of Idaho to be a City of the Second Class and changing the Corporate Name of the Municipality from the Village of Emmett to the City of Emmett.
   WHEREAS, A petition duly signed by a number of the qualified electors of the Village of Emmett, Idaho, equal to more than three- fifths of the total vote as shown by the last preceding general election held in said Village, has been presented to the Board of Trustees of said Village praying that the Village of Emmett be discontinued as a corporate organization and that the inhabitants thereof be organized as a City of the second class, the City government to take effect immediately after the next general Village election therein, to be held on the first Tuesday of April, 1909, and
   WHEREAS, It appearing to said Board of Trustees after due and proper investigation that the said Village of Emmett contains more than one thousand inhabitants and that said petition is signed by more than three-fifths of the qualified voters therein and the same has been duly filed with the Clerk of said Village, as required by law.
   THEREFORE, BE IT RESOLVED, By the Chairman and Board of Trustees of the Village of Emmett, Canyon County, State of Idaho.
   First. That in accordance with the foregoing named petition and by virtue of the law of the State of Idaho enacted by the Legislature thereof in the year 1903 as amended by the Session Law of said State in the year 1907 entitled, "An Act to Enable Villages to Become Organized as Cities of the Second Class and providing for the Powers, Duties and Liabilities of Cities so organized and prescribing the Means for Carrying such Organization into Effect", that the organization of the Village of Emmett, Idaho, be and the same is hereby discontinued and said municipality is hereby declared to be a City of the Second Class.
   Second. That the corporate name of said Village of Emmett is hereby discontinued and is changed to that of the City of Emmett and said municipality shall hereafter be designated and known as the City of Emmett.
   Third. That the City government herein provided for shall be in force and take effect only immediately after the said general Village election to be held therein on the first Tuesday in April, A. D., 1909.
  Adopted this 7th day of December, 1908.

   THEREFORE, BE IT RESOLVED BY THE Board of County Commissioners, of the County of Canyon, State of Idaho, that in accordance with said resolutions aforesaid on file herein and by virtue of the laws of the State of Idaho enacted by the Legislature thereof in the year 1903 as amended by the Session laws of said State in the year 1907, entitled "An Act to Enable Villages to Become Organized as Cities of the Second Class and Providing for the Power, Duties and Liabilities of Cities so Organized and Prescribing the means for Carrying such Organizations into effect", that the organization of the Village of Emmett, Idaho, be and the same is hereby discontinued and the said municipality is hereby declared to be a city of the Second Class, that the corporate name of said Village of Emmett is hereby discontinued and is changed to that of the City of Emmett and said municipality shall hereafter be designated and known as the City of Emmett, whose metes and bound shall be and are hereby declared to be as follows:
   Beginning at the Southeast corner of the SW 1/4 of the NW 1/4 of Section 8, in Township 6 North of range 1 West of the Boise Meridian and running West along the 1/4 Section line to the Southwest corner of said SW 1/4 of the NW 1/4 thence South along the Section line of said Section 8 to the Southeast corner of the NE 1/4 of Section 7 said Township and range thence West on the 1/41/4 Section line to the Southwest corner of said NE 1/4 of the SE 1/4 of Section 7 thence South on the 1/41/4 Section line to the Section line between Sections 7 and 18, thence West on said Section line to the Southwest corner of the SE 1/4 of said Section 7, thence North on 1/4 Section line to the Southwest corner of the NE 1/4 of said Section 7, thence running West 1/4 mile, thence North to the Payette River, thence following the said river to the North line of said Section 7, thence following said Section line East to the West line of Lot 11, in Section 6 Township 6 North of Range 1 West, thence North on said West line to the North line of lot 11, thence East along said North line to the Northeast corner of said Lot 11, thence South on the East line of Lot 11 to a point on the South side of the right of way of the Farmers Co-operative Irrigation Company, thence West 3 feet along said right of way, thence South to a point 15 feet West of the Northwest corner of the NW 1/4 of Section 8 in Township 6 North of Range 1 West, thence East along the North line of said NW 1/4 of said Section 8 to the Northeast corner of the NW 1/4 of the NW 1/4 of said Section, thence South on the 1/41/4 Section line to the place of beginning.
   Which are the metes and bounds of the Original Village of Emmett a more particular description of which is set out in the Record of Canyon County, Idaho, which said description is hereby referred to and made a part hereof together with all those certain additions, pieces, parcels and plots of ground annexed to, taken into and made a part of said Original Village of Emmett by Ordinances of said Village numbered 21-38-39 and 48, duly and legally enacted, passed and published, the descriptions of which said lots, pieces and parcels and additions being therein set forth and are hereby referred to and made a part hereof.
   That the City government herein provided for shall be in force and take effect only immediately after the next general Village election to be held Therein on the first Tuesday of April, A.D., 1909.
   Adopted this 20th day of January, A.D., 1909.
