§ 152.03 MEMBERSHIP.
   (A)   There is hereby created the Henry County, New Castle, Eminence, Campbellsburg, Smithfield, and Pleasureville Joint Planning and Zoning Commission which shall consist of 11 members. The Henry County Judge/Executive and Mayors of the cities of New Castle, Eminence, Campbellsburg, Smithfield, and Pleasureville with the approval of their respective legislative bodies shall appoint the members of the Planning and Zoning Commission, at least two-thirds of whom shall be citizen members. The Henry County Judge/Executive shall appoint six members from the county at large. The mayors of New Castle, Eminence, Campbellsburg, Smithfield, and Pleasureville shall each appoint one member from within the corporate limits of the city. Provided, however, should the Mayor of any of the said cities be unable to find a qualified individual from within the corporate limits of that city, and be unable to do so for a period of thirty (30) days, then said Mayor may appoint a person to represent said city who is a resident of Henry County residing outside of the city limits.
   (B)   Terms of the members shall be four years except that the initial appointment shall be as follows:
      (1)   Three of the County Judge/Executive’s appointments shall be for a one-year period.
      (2)   Three of the County Judge/Executive’s appointments shall be for a two-year period.
      (3)   The initial appointment of Pleasureville, Campbellsburg, and Eminence shall be for a three-year period.
      (4)   Upon expiration of this original term the appointing authority may reappoint or appoint a new member for the full four-year term. All vacancies shall be filled within 60 days by the appropriate appointing authority.
      (5)   Should any member be appointed who is a non-citizen member then that member’s appointment shall only be for his term of office. No members shall receive compensation but may receive reimbursement for expenses incurred in the performance of their duties.
   (C)   The oath of office shall be administered to all members of the Commission before entering upon their duties. The oath shall be administered as provided by law. A member may be removed by the appropriate appointing authority for inefficiency, neglect of duty, malfeasance or conflict of interest. The removed members shall have the right of appeal as provided in KRS Chapter 100.
