§ 151.028 VIOLATING STORAGE TANK REGULATIONS.
   A person is guilty of violating storage tank regulations when, being the owner or occupant, or high managerial agent, of any commercial or residential property or structure, he or she:
   (A)   Allows or permits to exist thereon, any storage tank (whether above ground or below ground) in excess of 500 gallons unless the said tank meets the following requirements:
      (1)   Complies with all state and federal regulations; and
      (2)   Is properly sealed to prevent leakage; and
      (3)   Is screened by structure or vegetation that is not otherwise in violation of any section of this chapter;
   (B)   Fails to actively utilize said tanks for a period of months.
