A person is guilty of failure to maintain a sanitary premises when, being the owner and/or occupant, or high managerial agent, of any commercial, residential or industrial real estate, he or she:
(A) Fails to maintain the premises in such manner so as to keep the premises free of vermin, rodents, filth or debris; or
(B) Fails to maintain the shared or common areas of the premises to keep the same clean and sanitary; or
(C) Being the occupant of any structure or real estate, fails to keep that part of the structure and/or real estate which he or she occupies or which is provided for his or her use in a clean and sanitary condition.
