A person is guilty of failure to properly utilize garbage disposal facilities when he or she:
(A) Places garbage, including organic waste and rubbish, on the ground outside a residential or commercial structure; or
(B) Being an owner or tenant or high managerial agent, allows garbage, including organic waste and rubbish, to be placed upon the ground outside a residential or commercial structure; or
(C) Fails to place garbage, including organic waste and rubbish, in the approved garbage storage containers with lids; or
(D) Places his or her garbage in unapproved containers; or
(E) Fails to immediately remedy any condition upon which he or she has notice that results in a violation of this section.
