A person is guilty of failure to have a hot and cold water supply when, being the owner and/or occupant, or high managerial agent, of any residential, commercial or industrial property or real estate, he or she:
(A) Fails to have connected to the kitchen sink, lavatory, and tub or shower an adequate supply of both cold water and hot water; or
(B) Fails to have the water supplied through an approved distribution system connected to a potable water supply.
