§ 111.09 BUCKET BRIGADES.
   (A)   Whereas, certain charitable and other organizations have in the past and desire in the future to conduct activities in the streets of Eminence, Kentucky, for the purpose of obtaining charitable contributions from passers-by and;
   (B)   Whereas, said activities have come to be properly known as "Bucket Brigades";
   (C)   Now therefore, be it ordained by the city council of the City of Eminence, Kentucky, as
follows:
      (1)    Bucket Brigade activity shall be defined as collection and sales for charitable purposes which take place on a street or highway in the city limits of Eminence, Kentucky.
      (2)    All "Bucket Brigade" collection activities shall be conducted at the intersection of Main Street (Hwy 55) and Broadway (Highway 22) between the hours of 9:00 am and 12:00 noon on designated Saturdays and no such activities shall be conducted at any other location within Eminence limits at any other times. Provided, however if the above designated intersection is blocked or unusable, the City Council, upon request, may designate an alternate location to conduct "Bucket Brigades";
      (3)   There shall be a total of six (6) "Bucket Brigades" allowed per year beginning January 1, 2013 and there shall be no more than two (2) "Bucket Brigades" in any one (1) month period.
      (4)   All participants in "Bucket Brigade" collection activities must be either non-profit organizations recognized under IRS Section 501(c) (3) or agencies of city government with activities in the City of Eminence, Kentucky area. Other organizations which are not governmental agencies or Section 501(c) (3) organizations must apply directly to the Eminence City Council at a regularly called meeting to obtain permission to conduct a "Bucket Brigade".
      (5)   All qualified organizations as identified in subsection (C)(3) shall apply to the Eminence City Clerk, on a form designated by the City Clerk, to obtain permission to conduct a "Bucket Brigade" collection activity for a particular date. No organization shall normally be allowed more than one date per year. However, if the total number of dates has not been committed by September 1, of each year then the organization may apply for a second "Bucket Brigade" in the fall (autumn) of that year.
      (6)   The number of persons participating in a "Bucket Brigade" shall be limited to a total of eight (8) persons at any one time.
      (7)   All persons participating in collection activities in a "Bucket Brigade" shall be at least eighteen (18) years of age and shall wear distinctive colored vests provided by the City of Eminence. All persons participating in the collection activity of a "Bucket Brigade" shall sign a waiver furnished by the Eminence City Clerk and have the waivers delivered to the office of the Eminence City Clerk on or before the Thursday immediately preceding the Saturday "Bucket Brigade". All waivers shall acknowledge the danger of collection activity and shall exonerate and hold harmless the city of Eminence, Kentucky, or any of its officers, agents or employees for injury or death of a person participating in the collection activity. All waivers shall contain a notary certificate substantially as follows:

      (8)   Each organization conducting a "Bucket Brigade" shall provide to every donor a flier, leaflet or other paper containing the name and address of the organization.
      (9)   Provided, nothing herein shall be deemed to apply to restrict bucket brigade activity conducted by the Eminence Volunteer Fire Department.
      (10)   Any person or organization operating a Bucket Brigade in violation hereof shall be subject to a fine not to exceed five hundred dollars ($500.00) and each day of violation shall be considered a separate offense.
