(A) Any person who fails to notify the DES Director of a release or threatened release may be fined not more than five thousand dollars ($5,000.00) per offense. Each day’s continuance of any such failure or violations shall be considered a separate offense.
(B) Any person who fails to comply with any other provisions of this chapter may be fined not more than five hundred dollars ($500.00) per offense. Each day’s continuance of any such failure or violation shall be considered a separate offense.
