§ 93.22 OPEN BURNING.
   (A)   No person shall cause, suffer or allow any open burning of grass, weeds, leaves, lumber, straw, trash or any other combustible material within the city limits without a burning permit issued by the city Fire Chief.
   (B)   (1)   Any person seeking to obtain a permit from the city Fire Chief for open burning shall do so in writing on a form to be provided by the city and which shall provide sufficient information to allow the Fire Chief to make an informed decision.
      (2)   The Fire Chief shall issue the permits and shall state the date, time, location and materials for which permission is granted in a written permit to be issued to the applicant.
      (3)   In determining whether it is appropriate to issue such permit, the Fire Chief shall consider the materials, location, proximity to other combustible materials, danger to persons and property, weather conditions and all relevant factors to determine whether it is appropriate to permit the requested burning.
      (4)   Decisions as to whether to permit any requested burning are in the sole discretion of the city Fire Chief from which there is no appeal.
   (C)   A controlled fire which is not open and which is contained completely within a metal container with sufficient grate or other protection so as not to permit floating debris or excessive smoke is permitted and is an exception to the provisions of subsections (A) and (B) above.
   (D)   The burning of household or commercial garbage is prohibited.
