§ 91.34 ACTIVITIES IN CITY RIGHTS-OF-WAY ADJACENT TO PUBLIC WAYS.
   (A)   It shall be unlawful for any owner or occupant of property in the city to maintain within the right-of-way to any street or road or within ten feet of the paved portion of any street or road in the city any of the following: athletic equipment, basketball goals, toys, recreational equipment, tools or similar items.
   (B)   It shall be unlawful for any person to engage in any activity that causes said person to occupy space on a public way in the city for any purpose other than pedestrian or vehicular traffic.
   (C)   Any person found to be in violation of this section shall be guilty of a violation and shall be subject to a fine not to exceed $100 for each offense. Each day that any violation continues shall constitute a separate offense.
   (D)   The invalidity of any portion of this section shall not affect the validity of this section as a whole. It being the intention of the City Council to enact this section item by item.
