§ 71.28 VEHICLE NOT TO BE LEFT IDLING.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      (1)   OPERATOR. Any person who is either the owner of a vehicle which falls under the terms of this section or who is charged with the responsibility of the care of such a vehicle for any period of time.
      (2)   VEHICLE. Any automobile, motorcycle, tractor, truck, or other motorized, petroleum burning machine capable of carrying a pay load of passengers or other cargo.
   (B)   It shall be unlawful for any operator of any motor vehicle to allow any vehicle under his or her control to remain idling for a period of time in excess of 30 consecutive minutes unless the vehicle is attended by the operator.
   (C)   Any person, firm, or corporation found to be in violation of this section shall receive one warning in writing from the Police Department. Should a person be found to be in violation of this section after having received such warning, such person, firm, or corporation shall be cited on a uniform citation and shall be held responsible for a fine as set forth in § 71.99.
