§ 50.04 PRIVATE WASTEWATER DISPOSAL.
   (A)   Where a public sewer is not available under the provisions of § 50.03(C) of this chapter, the building sewer shall be connected to a private wastewater disposal system complying with the provisions of this city code.
   (B)   (1)   At such time as a public sewer becomes available to a property serviced by a private wastewater disposal system, a direct connection shall be made to the public sewer in compliance with § 50.03(C) of this chapter, and within 90 days of connection the private wastewater disposal system shall be abandoned in accordance with Minn. Rules Ch. 7080, as amended, with record of compliance delivered to the city within 60 days of abandonment of the private wastewater disposal system.
      (2)   For those properties which are serviced by a private wastewater disposal system, and which are located more than 100 feet from the operating municipal wastewater system, but less than 200 feet from the municipal wastewater system, and for which the private wastewater disposal system is deemed to be failing, or for which an upgrade is necessary for any reason, those owners shall be required, at the owner’s expense, to install a suitable service connection to the public sewer system in accordance with the provisions of this chapter within nine months of the date the city notifies the owner of the need to install a suitable service connection to the public sewer system. Any such property owner notified of the need to install a suitable service connection shall pay the connection fee in place at that time, in addition to the costs required to install the suitable service connection.
