§ 31.17 LIBRARY BOARD.
   (A)   A City Public Library is hereby continued.
   (B)   Establishment. A City Library Board is hereby established. The Library Board shall report to the City Council regarding the governance of the free City of Emily Public Library for the sole purpose of documenting board decisions and rulings in the Council minutes of the city for audit purposes.
   (C)   Appointment of members; terms of office.
      (1)   The Library Board shall consist of five members, to be appointed by the Mayor, with Council approval. The Council may select one member of the board from among its own members.
      (2)   The Library Board of five members shall serve staggered three-year terms and can serve for up to three consecutive terms ending on December 31 of each year. Successive appointees shall hold their offices until their successors are appointed and qualified. Vacancies during the term shall be filled by the Mayor with approval of the Council for the unexpired portion of the term. All members shall serve without compensation.
   (D)   Officers; meetings; annual report.
      (1)   The board shall elect a Chairperson from among its appointed members. The Chairperson shall serve at the pleasure of the Board.
      (2)   The Library Board shall hold at least one annual meeting.
      (3)   The Library Board shall make an annual report to the City Council.
   (E)   Duties.
      (1)   The board shall adopt such additional operational bylaws and regulations which pertain specifically to the daily operations of the library, as approved by the City Council. However, the operational bylaws of the library shall not conflict with the City of Emily policies. The operational bylaws and regulations will be reviewed annually and updated as necessary.
      (2)   It shall be the responsibility of the Board to assist the City Clerk/Treasurer in developing a budget.
      (3)   The board, when requested by the City Council, shall consider, investigate, make findings, report, and recommend upon any special matter of question coming within the scope of its work.
      (4)   The Library Board may accept any gift, grant, devise or bequest made by any person with City Council consent per resolution.
   (F)   Director/Librarian; appointment and responsibilities.
      (1)   The Library Board shall appoint a qualified Library Director/Librarian and other staff as necessary, establish compensation of employees in compliance with the city's pay equity schedule and remove any of them for cause. The appointments shall be reported to the City Council for payroll and audit purposes.
      (2)   The Director/Librarian shall have the responsibility for the day to day administration of the library.
      (3)   The Director/Librarian shall recommend policies to the Board for action.
      (4)   The Director/Librarian shall be responsible for personnel, financial administration and public relations and is responsible for the overall quality of the library service to the public.
   (G)   Personnel policy. The personnel policy of the City of Emily Public Library shall be the City of Emily Personnel Policy.
   (H)   Library fund/assets.
      (1)   The City Council shall establish a library fund by annually budgeting money for the library.
      (2)   The Library Board shall have control of the expenditure of all monies collected for or placed in the credit of the library fund.
      (3)   Expenditures of the board shall be within the amount appropriated by the City Council through adoption of an annual library budget and levy.
      (4)   The City Clerk/Treasurer shall act as custodian of library funds appropriated for operation and maintenance of the library facility. They shall provide the Library Board an annual report of receipts, disbursements, investments, and budget comparison in the same manner as for all other funds of the city.
      (5)   All real property given, granted, donated or bequeathed to the Public Library shall be vested and held and in the name of the City of Emily.
   (I)   Conformance to statute. The board shall operate in conformance with M.S. Ch. 134, as may be amended from time to time, and may cooperate with any regional library system that the board deems to provide the best services available to the city and surrounding community.
