§ 152.111 BULK SAMPLING OF MINERAL MANGANESE.
   Where allowed, the bulk sampling of mineral manganese shall conform to the following requirements.
   (A)   An application shall not be submitted until an environmental assessment worksheet has been completed and the subsequent environmental review process has been completed.
   (B)   Official notification requirements shall be expanded to include notification of all property owners within one mile of the property.
   (C)   Industrial-scaled structures exceeding the normal height limitations and accessory to the bulk sampling operation may be permitted, without the need to demonstrate a hardship, as part of the interim use permit request.
   (D)   Noise shall be monitored periodically during the sampling operation. A schedule for monitoring shall be prepared as part of the permit process.
   (E)   Drivers hauling to and from the site shall be briefed to not use a jake-brake.
   (F)   The hours of operation shall be specified in the permit.
   (G)   Improvements recommended by the Department of Transportation shall be implemented as part of the permit.
   (H)   The applicant shall identify financial security and insurance coverage that has been, or will be, provided to regulating agencies to cover the potential cleanup of spills and the ultimate restoration of the property.
   (I)   Adequate measures to control dust shall be detailed in the permit.
   (J)   A schedule for monitoring the moisture content of the loads to reduce dust shall be prepared as part of the permit process.
   (K)   Burning of site debris shall be prohibited.
   (L)   The amount of stockpiling of materials shall be calibrated to ensure materials do not dry out prior to transport.
   (M)   A schedule for lake monitoring shall be prepared and implemented as part of the permit.
   (N)   The applicant shall be required to hold on-going public meetings to report on the operation and ongoing test results at a schedule to be included in the permit.
   (O)   Improvements accessory to the operation shall be removed, and the site restored, within a specified timeframe following the completion of the sampling operation.
   (P)   A schedule for well monitoring shall be prepared and implemented as part of the permit.
   (Q)   The applicant shall be informed that the lack of negative impacts from a sampling operation do not automatically denote the lack of negative impacts from a full-scale mining operation.
   (R)   The route to the processing facility shall be defined as part of the process.
