(A) The developer is required to provide the design and installation of a subsurface drainage system when determined to be necessary by the City Engineer or as specified necessary in the project specific geotechnical report.
(B) Design and construction of the subsurface drainage system shall conform to the recommendations by the project geotechnical engineer.
(C) Subsurface drainage systems shall not be combined or connected with a storm drain pipe system and shall discharge into an approved drainage in which the developer has acquired drainage rights or has been appropriately permitted to do so.
(D) The developer shall maintain all pre-existing subsurface drainage in all of its forms, including drain lines and drain tiles.
(1) If the developer discovers a pre-existing subsurface drainage system after the start of excavation that were unknown (i.e., not identified on the developer’s subsurface drainage system plan) at the time of the design and approval of the developer’s subsurface drainage system, the developer shall cease all excavation and shall immediately consult with the City Engineer and city’s Public Works Director to ensure that there was no damage to the pre-existing subsurface drainage because of the excavation and to ensure that the developer’s subsurface drainage system will still work while maintaining the pre-existing subsurface drainage system.
(2) The developer shall not be allowed to move forward with excavation or installation of his, her, or their previously approved subsurface drainage system, until the City Engineer has approved the developer’s amended subsurface drainage system.
(3) If during excavation, a developer discovers an unknown pre-existing subsurface drainage system and does not notify the City Engineer and/or reburies the system before the City Engineer can inspect it, the developer shall be responsible for all costs required to unbury the pre-existing subsurface drainage system and repair the system if needed or any other associated costs to remedy the situation so that the subsurface drainage system operates properly.
