(A) The terms defined or described in the recitals of the ordinance codified herein shall have the same meanings when used in the body of this section.
(B) All actions heretofore taken (not inconsistent with the provisions of this section) by the City Council and by the officers of the city directed toward the calling and holding of electronic meetings are hereby ratified, approved, and confirmed, provided such actions conform to the provisions herein.
(C) Any meeting of the City Council may be called and held electronically provided such meeting is called in conformance with the state’s Open and Public Meetings Act, being UCA Title 52, Chapter 4 (UCA §§ 52-4-1 et seq.), as amended, and consistent with the procedures set forth herein.
(D) The City Council chambers where the City Council would normally meet if it was not holding an electronic meeting, currently located at 5235 West 8800 North, City Hall, in Elwood, Utah, shall be the anchor location for all electronic meetings and the City Council finds that such chambers proved space and facilities so that interested persons and the public may attend and monitor the open portions of the meeting, whether such meeting is a public hearing or otherwise.
(E) To call an electronic meeting, public notice of such meeting must be given at least 24 hours before the meeting by:
(1) Posting written notice at the anchor location;
(2) Providing written or electronic notice to:
(a) At least one newspaper of general circulation within the state and in the city; and
(b) To a local media correspondent.
(3) Providing notice of the electronic meeting to the members of the City Council at least 24 hours before the meeting so that they may participate in and be counted as present for all purposes, including the determination that a quorum is present; and
(4) Providing a description to the members of the City Council of how the members will be connected to the electronic meeting.
(F) City officers, commissions, and committees are hereby authorized to meet by electronic means, such as conferencing services provided on the internet, e-mail, the city’s website, or telephone.
(G) Individual members of the City Council, commissions, or committees can attend and participate in public meeting by electronic means when unable to attend public meetings in person.
