§ 150.080 FINAL MINOR SUBDIVISION APPLICATION - EFFECT OF APPROVAL AND EFFECTIVE PERIOD.
   (A)   The approval of a final minor subdivision application, with or without requirements, by the City Council shall constitute a final approval of the subdivision by the city.
   (B)   After the approval of the final subdivision application by the City Council, the following signatures shall be placed on the Mylar copies of the final minor subdivision plat, as acknowledgment and certification:
      (1)   City Planning Commission Chairperson;
      (2)    Mayor; and
      (3)   Attest: City Recorder.
   (C)   After the approved final minor subdivision plat has been acknowledged and certified and all other required entities listed on the plat have signed the plat, the owner(s) of the subject property shall, within 90 days of the date of approval of the final subdivision application, record the approved final minor subdivision plat in the office of the County Recorder. The applicant shall pay all fees, including copies, for the recording of the final plat and all final subdivision documents by a licensed title company.
   (D)   The applicant shall provide one copy of the executed subdivision improvement agreement.
   (E)   The applicant shall provide one Mylar copy of the recorded final minor subdivision plat to the City Recorder for inclusion in the files of the city.
   (F)   After the final plat has been recorded and after a preconstruction meeting has been held, the applicant may apply for necessary permits required for the construction and installation of subdivision improvements consistent with the approved and recorded final minor subdivision plat and the subdivision improvement agreement.
   (G)   The continuing validity of a final subdivision application approval is conditioned upon the applicant proceeding after approval to implement the approval with reasonable diligence. For the purposes of this subchapter, and this requirement, the approval of a final subdivision application shall be effective for a period of 90 days from the date of approval by the City Council, at the end of which time the applicant shall have presented the final minor subdivision plat for recording in the office of the County Recorder. If the final minor subdivision plat is not recorded within 90 days of approval, the final subdivision application shall be rendered void and invalid.
