§ 153.76 MEMBERSHIP.
   (A)   Residency requirements. All members of the BOA shall reside within the village or within territory contiguous to the village, but not more than one and one-half miles beyond the corporate limits and not included within any other municipality.
   (B)   Specific membership requirements. Notwithstanding the general membership requirements established in division (A) above, the members of the BOA shall be qualified by experience and training to address matters pertaining to property maintenance and shall not be employees of the village. The Code Official shall be an ex-officio member, but shall have no vote on any matter before the BOA.
   (C)   Number. The BOA shall consist of three members unless otherwise modified by the Corporate Authorities.
   (D)   Alternate members. An additional two or more individuals shall be appointed in accordance with division (E) below, to serve as alternate members to hear appeals at the request of the BOA Chairman upon the occurrence of an absence or disqualification of a regular member. Alternate members shall possess the qualifications required for BOA membership pursuant to divisions (A) and (B) above.
   (E)   Appointment. Except as otherwise provided herein, the members of the BOA shall be subject to the appointment by the Village President with the advice and consent of the Board of Trustees and shall serve without compensation.
   (F)   Chairman. The BOA shall annually select one of its members to serve as chairman.
   (G)   Secretary. The Village Administrator shall designate a qualified person to serve as secretary to the BOA. The secretary shall file a detailed record of all proceedings in the office of the Village Administrator. The secretary shall not be a member of the BOA.
   (H)   Term. Except as otherwise provided herein, the terms for members of the BOA are hereby established in the following manner, or until their successors are appointed and have qualified:
      (1)   One member shall serve a two-year term;
      (2)   One member shall serve a three-year term;
      (3)   One member shall serve a four-year term; and
      (4)   Each alternate member shall serve a one-year term.
   (I)   Disqualification of member. A member shall not hear an appeal in which that member has a personal, professional or financial interest.
   (J)   Resignation. A member of the BOA may resign at any time by giving written notice to the member(s) and Corporate Authorities. The resignation of the member shall take effect upon receipt of notice thereof or at such later time as shall be specified in the notice; and, unless otherwise specified therein, the acceptance of the resignation shall not be necessary to make it effective.
   (K)   Removal of members. The Village President may remove any member of the BOA, with the advice and consent of the Village Board of Trustees whenever the best interest of the village shall be served thereby.
   (L)   Vacancies. A member appointed to fill a vacancy shall be appointed for the unexpired term of his or her predecessor in office, and shall hold office until the expiration of such term or until a successor shall be appointed, and shall qualify until his or her earlier death, resignation, or removal.
