§ 95.23 ENFORCEMENT PROCEDURE.
   (A)   Upon finding of a violation of the requirements herein established, the person causing or permitting the nuisance to continue shall be advised of the violation and given an opportunity to abate the noise level to an acceptable standard.
   (B)   If the person causing or permitting the nuisance does not cause the cessation of the nuisance within a reasonable period of time, that person shall be fined not less than $100 to be paid as a penalty.
   (C)   If the person causing or permitting the nuisance has previously been advised of a violation as provided in division (A) above, then upon finding of a subsequent violation of the requirements herein established, the person causing or permitting the nuisance shall immediately be fined not less than $100, without being given the opportunity to abate the noise level.
