§ 93.04 TRIMMING AND MAINTENANCE OF TREES AND SHRUBS.
   (A)   Owners of abutting premises shall maintain and trim trees and shrubs planted near or overhanging streets and sidewalks as necessary to promote the health and appearance of the plantings and to avoid the obstruction of vision, vehicular or pedestrian traffic and utility construction or maintenance on the streets and sidewalks.
   (B)   In the event that an owner or resident neglects or refuses to trim or maintain the plantings, and a potential or actual public safety hazard is presented because of the plantings, and if the resident or owner fails to alleviate the hazard or obstruction within ten days after notice from the village, or without notice if the resident or owner cannot readily be found and the hazard or obstruction poses an urgent threat to the public health or safety, then the plantings shall be deemed a nuisance and shall be summarily trimmed or removed by the village. The expense of the trimming or removal shall be recoverable from the resident or owner. In the event that the owner does not live on the premises, notice may be sent by first class mail to the owner’s last known address, and the mailed notice shall be deemed adequate.
   (C)   Residents are cautioned to exercise care in trimming or maintaining trees and shrubs near utility lines and shall contact professional, bonded contractors to perform the services. In the event that a resident or owner neglects or refuses to trim or maintain plantings on private property in close proximity to utility lines, the village and its agents or contractors shall have the right to enter upon the property to perform the necessary or appropriate trimming, maintenance or removal services.
