§ 92.53 DAMAGE TO MAILBOXES.
   The following provisions shall apply to any lawfully installed mailbox which is damaged or knocked down as a result of village snow removal operations:
   (A)   Damage caused by direct contact with village vehicles or by snow discharge from a village vehicle.
      (1)   Repair. Any mailbox that is damaged or dislocated during village snow removal operations through direct contact with any public works vehicle or snow discharge from any public works vehicle, as determined by the Public Works Director, or his or her designee, shall be repaired, if practical, at the expense of the village, but in no event, in an amount exceeding $50.
      (2)   Reimbursement. In the event the Public Works Director deems it impractical to repair a properly installed mailbox, the village shall reimburse the owner the sum of $50 as full and final satisfaction of the village’s obligation hereunder. In no event shall the village be responsible for any additional cost, lost value or aesthetics.
   (B)   Damage to improperly installed or non-compliant mailboxes or other structures. Damage to any unlawfully installed mailbox or other structure, whether by direct contact with village vehicles or otherwise during the regular authorized operations by the village, shall be deemed an event that no experience, foresight or reasonable care by the Public Works Department personnel may guard against and, therefore, the village shall not be responsible therefore.
