The Police Department shall be charged with the duty of enforcing the provisions of this chapter. The corporate authorities for the village shall enter and maintain any agreements necessary to allow utilization of the county animal control facilities for impound services as set forth herein.
(A) Animals at large.
(1) The Police Department shall seize and impound any dog, cat or other domestic animal running at large.
(2) The Police Department shall make reasonable attempts to immediately notify the owners of the dog, cat or other domestic animal by mail if he or she can be identified.
(3) The Police Department shall also cite the owner or keeper of the dog, cat or other domestic animal to answer charges of violation of this chapter.
(B) Rabid animals. Any dog, cat or other domestic animal determined to be or reasonably suspected of being rabid, or having been bitten or infected by a rabid animal, domestic or otherwise, shall be immediately impounded and held by County Animal Control pursuant to the provisions set forth in the County Animal Control Ordinance.
(C) Animals causing injury.
(1) Any dog, cat or other domestic animal which shall have bitten or otherwise injured any person, companion animal, guide dog or K-9 so as to cause an abrasion of the skin shall be immediately taken, impounded by County Animal Control pursuant to law as set forth in the Will County Animal Control Ordinance, including its provisions for imposing liability upon an owner or keeper for costs assessed or incurred.
(2) In the event the dog, cat or other domestic animal cannot be safely taken up and impounded, it may be shot, care being taken to preserve the head intact which shall thereupon be immediately detached and delivered to the diagnostic laboratory of the Department of Agriculture.
(3) After having been notified that the owner’s dog, cat or other domestic animal has bitten or otherwise injured any person, companion animal, guide dog or K-9, the owner or keeper thereof shall not, under any circumstance, permit the animal to be at large unless secured by a muzzle.
(D) Obstruction of enforcement. Any person who shall, in any way, prevent or attempt to prevent the village or the Police Department from performing any duty herein required shall be guilty of violation of this chapter.
