(A) Whenever charges for water and/or sewer services remain unpaid for 60 days or more, the Village President, or his/her designee, may file a statement of lien claim with the recorder of deeds of Will County, Illinois. The lien statement shall contain a legal description of the property charged, the outstanding amount due, including any administrative costs associated with the delinquent account, the date that the account became delinquent and a notice that the Village of Elwood claims a lien for such amount.
(B) An error in the calculation of the amount due referenced in the notice of lien shall not defeat the claim lien.
(C) If payment for water and/or sewer services remain unpaid, the Village Attorney, or his or her designee, may file or cause to be filed a complaint in the circuit court of Will County to foreclose upon such lien.
