50.11 FAILURE TO TIMELY PAY WATER AND SEWER BILLS.
   (A)   Any consumer to whom water and sewer services were provided shall promptly pay all charges when they become due and payable.
   (B)   The failure to pay the full amount due and payable within 30 days of the date of billing shall constitute a delinquency.
   (C)   The following procedures shall be followed when a consumer account is found to be delinquent:
      (1)   The Village Clerk shall mail or cause to be mailed to the address against which a water and/or sewer bill is due a notice of delinquency. Provided, however, if the occupant of the property is
not the owner and the Village Clerk has knowledge of the owner's residential address, the Village Clerk shall mail the notice to the owner of the property. The notice of delinquency shall set forth the nature and amount of the bill(s) that remain unpaid. The failure of the Village Clerk to mail such notice does not constitute a waiver or effect the consumer's obligation to pay the outstanding bill.
      (2)   If any such delinquent bill remains unpaid 30 days after the notice of delinquency was mailed, the public works department shall shut off the water and/or sewer service, whichever is applicable. Provided, however, the failure of the Village Public Works Department to disconnect service does not constitute a waiver of any remedy available to the village pursuant to this chapter.
