§ 34.02 RULES, REGULATIONS AND PROCEDURES; RECORDING OF OPEN MEETINGS.
   (A)   Incorporation. The preambles to the ordinance codified herein be and the same are hereby incorporated herein by this reference as if set out in full at this place.
   (B)   Notice that meeting is being recorded.
      (1)   The Chairperson shall announce at the beginning of each recorded meeting the fact that the meeting is being recorded, and that anyone who speaks at the meeting shall be deemed to have given his or her consent to the recording of their likeness and speech for the limited purposes allowed hereunder.
      (2)   The notice and/or agenda for the meeting shall also include a similar written reference.
   (C)   Limitations imposed. Only the official proceedings beginning with the call to order through the adjournment may be recorded and no statements before or after the official meeting may be recorded unless the express consent of the individual recorded has been given.
   (D)   Closed or executive sessions. All video and audio recording equipment must be removed from the meeting room prior to the commencement of any closed or executive session.
   (E)   Physical requirements.
      (1)   All recording equipment must be of a type that will operate quietly and unobtrusively so as not to disturb or disrupt the meeting.
      (2)   No artificial lighting may be used in conjunction with the recording of a meeting.
      (3)   Video cameras and equipment shall only be placed in designated areas and located in such a manner so as not to obstruct the view of other attendees. In no event shall the village be liable for damage to any recording device nor for the quality of reproduction based on or related to the facility conditions.
   (F)   Exemption from regulations.
      (1)   Any recording of a meeting by the Village Clerk, Deputy Village Clerk or Secretary of any subsidiary body of the village or individual member thereof shall be exempt from the rules and regulations established herein.
      (2)   Any bona fide news medium as determined by the Village President shall be exempt from the rules and regulations established herein, except for those established through division (D) above.
